Rights & Reproductions: Print Media Guidelines
1. The reproduction must be full-tone black and white or full color and may not be reproduced on colored paper stock. Nothing may be superimposed on the reproduction, such as lettering, tone, or another image.
2. Each work must be reproduced in its entirety and the reproduction may not be bled off the page or cropped in any way. Reproductions must be smaller than the original work of art. For extremely small works of art, the reproduction may be larger than the original provided that the dimensions are stated prominently in the caption which accompanies the original.
A detail is defined as a section of an image that comprises 70% or less of the full image. Any higher percentage is considered cropping and is unacceptable. Details are permitted inside a publication only when they are required to illuminate a text reference and the caption indicates where the full image is reproduced in the same publication. Reproductions across the gutter of a publication are allowed only when they can be accomplished without any image loss.
3. Borders are the outer edges or boundaries of the work of art. Nothing may be artificially added to these limits which would appear to be an integral part of the work of art. In the case of images with margins which do not clearly define the boundaries of the work of art, a margin should be created around the image maintaining the same relative proportions as the image. Reproductions of prints should include the printed sheet in its entirety which contains the plate mark or limit of the printed image, the artist’s signature and inscriptions and the paper border to its outer edge.
4. A caption documenting each work must be placed in close proximity to the reproduction and must include the artist’s name, title of work, date of work, medium, size, ownership credit, and a copyright notice as follows: Art © Dedalus Foundation, Inc./Licensed by VAGA, New York, NY.
The following caption must be included for text by Motherwell: Text © Dedalus Foundation, Inc./Licensed by VAGA. New York, NY
5. Submission of color proofs is mandatory, and any corrections required by the Dedalus Foundation must be made.
6. For publications that contain more that ten (10) reproductions of works by Robert Motherwell, the Dedalus Foundation must be provided with a caption list for proofreading prior to publication. The calculation of the total number of reproductions includes both reproductions that appear inside the body of the text and reproductions that are being used as supplementary illustrations.
7. Special permission is required if the reproduction is to be featured as a frontispiece, chapter divider, book cover, or dust jacket.
8. Regarding reproductions of works used as cover illustrations, please note the following:
-If the cover is a separate sheet, such as a dust jacket, full documentation and copyright notice must appear with the reproduction, on the back cover, or on one of the end flaps.
-When the covers are bound together with the text, the full documentation and copyright notice should appear either directly under the reproduction or on the back cover; however, if there is a copyright page within the publication then only the artist’s name, along with the title and date of work (and “detail” when appropriate) may be listed with the reproduction on the back cover, so long as the full documentation and copyright notice are given on the copyright page.
-A reproduction of a detail of a work can be used as a cover illustration only if the complete work of art is reproduced prominently elsewhere as part of the same publication. When the detail is a color reproduction, the full image must also be in color. If the detail is black and white, the full image can be either full color or black and white. As with illustrations of complete images, the documentation must include the artist’s name, title of work, date of work, medium, size, ownership credit, copyright notice, and indicate that the reproduction is a detail.
9. Prior to publication, rights to reproduce any image or text by Motherwell must be cleared in writing with the Foundation’s copyright agent, VAGA (Visual Artists and Galleries Association, Inc.), 350 Fifth Ave, Suite 2820, New York, N.Y. 10118 (phone: 212-736-6666; fax: 212- 736-6767; email: info@vagarights.com). VAGA works in consort with the Foundation to ensure that all rights are cleared in accordance with the Foundation’s specific requirements.
